A Hindu Marriage Is Not Valid Without The Necessary Ceremonies Supreme Court

“Hindu marriage is not about feasts, entertainments, dowries, gifts. It is a bond bound by deep ritual. The process of marriage is accompanied by many commitments. For a Hindu marriage to be valid, rituals must be followed. Something like Saptapadi (seven steps around the sacred fire) should be practiced. When there are disputes in the marriage system.. at that time the Saptapada is proof.. it is not right to say that we have got a Hindu marriage without performing any rituals.. It is not right to say that we have got married in that system without following the religious ritual and knowing about the Hindu marriage system. Hindu marriage is a great event.. It enhances the respectable status of both men and women. Through this they raise their family. It makes them proud. The bench said that it will help them to expand their family further.

For validity..

“Section 7 of the Hindu Marriage Act is one. The marriage ceremony is valid only if it is performed according to Hindu customs. We cannot consider those who come to the court for divorce without getting married as husband and wife.. We consider this as a relationship between people. Hindu marriage is not a business transaction. Not at all an act of forceful dowry pressure. There is no word of better off in Hindu marriage. Husband and wife are equal parts in that process. The Hindu Marriage Act expressly prohibits polygamy and polygamy. Rules must be followed in such a system. Besides, it should not be done at will,” said a bench comprising Justice Nagaratna and Justice George Mahih. The divorce case related to the couple of the two pilots has been adjourned.
